These Terms and Conditions ("Terms") govern your use of the website at muhaiyar.com and any cleaning, maintenance, or facility management services provided by Muhaiyar Facility Services Sdn. Bhd. ("the Company", "we", "us", or "our"), a company registered in Malaysia. By accessing our website or engaging our services, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you should not use our website or services.

1. Definitions

  • "Client" refers to any individual, business, or organisation that engages our cleaning or facility maintenance services.
  • "Services" refers to all cleaning, sanitation, housekeeping, maintenance, and related facility management services offered by the Company.
  • "Website" refers to the website located at muhaiyar.com, including all pages, content, and functionality.
  • "Quotation" refers to the written estimate of charges provided by the Company for a specific scope of work.
  • "Agreement" refers to the binding arrangement formed when a Client accepts a Quotation or engages the Company's services.

2. Description of Services

Muhaiyar Facility Services Sdn. Bhd. provides professional cleaning and facility maintenance services across Johor Bahru and other areas within Malaysia. Our services include, but are not limited to:

  • Commercial office cleaning and janitorial services.
  • Residential house cleaning and housekeeping.
  • Post-renovation and post-construction cleaning.
  • Deep cleaning and sanitisation services.
  • High-rise and exterior window cleaning.
  • Floor care including stripping, waxing, and polishing.
  • Regular maintenance contracts for commercial and residential properties.

The specific scope, frequency, and details of any engagement will be outlined in the Quotation or service agreement provided to the Client prior to commencement of work.

3. Booking and Service Appointments

3.1 Requesting a Quotation

Clients may request a quotation by contacting us via our website contact form, email, phone, or WhatsApp. Quotations are provided free of charge and are valid for thirty (30) days from the date of issue unless otherwise stated.

3.2 Confirmation of Booking

A booking is confirmed once the Client accepts the Quotation in writing (including via email or messaging platforms) and any required deposit has been received. Upon confirmation, the Company will schedule the service according to the agreed date and time.

3.3 Access to Premises

The Client is responsible for ensuring that our cleaning team has adequate and safe access to the premises at the agreed time. If our team is unable to gain access or is denied entry upon arrival, the appointment may be treated as a late cancellation and the applicable charges will apply.

3.4 Cancellation by the Client

  • Cancellations made more than forty-eight (48) hours before the scheduled service will receive a full refund of any deposit paid.
  • Cancellations made between twenty-four (24) and forty-eight (48) hours before the scheduled service will incur a cancellation fee of 50% of the quoted service charge.
  • Cancellations made less than twenty-four (24) hours before the scheduled service, or failure to provide access at the agreed time, will be charged the full quoted amount.

3.5 Cancellation or Rescheduling by the Company

In rare circumstances, we may need to reschedule a service due to unforeseen events such as severe weather, public emergencies, or staff shortages. We will notify the Client as soon as possible and arrange an alternative date at no additional cost. If rescheduling is not acceptable to the Client, a full refund of any amounts paid will be issued.

4. Payment Terms

4.1 Pricing

All prices quoted are in Malaysian Ringgit (MYR) and are inclusive of standard labour and materials unless otherwise stated. Additional charges may apply for specialised cleaning agents, equipment, or services not included in the original Quotation.

4.2 Payment Methods

We accept payment via bank transfer, online transfer, and other methods as communicated at the time of booking. Cash payments may be accepted for certain services at our discretion.

4.3 Deposit

For certain services or contracts, a deposit of up to 50% of the total quoted amount may be required at the time of booking confirmation. The balance is due upon satisfactory completion of the service unless alternative payment terms have been agreed in writing.

4.4 Invoicing and Due Dates

For contract clients and commercial engagements, invoices are issued monthly or as agreed. Payment is due within fourteen (14) days of the invoice date unless otherwise specified. Late payments may incur a late fee of 1.5% per month on the outstanding balance.

4.5 Disputed Charges

If you wish to dispute any charge on an invoice, you must notify us in writing within seven (7) days of receiving the invoice. We will review the matter and respond within a reasonable timeframe.

5. Client Responsibilities

To enable us to deliver our services effectively and safely, the Client agrees to:

  • Provide accurate information about the premises, including size, condition, and any hazards or special requirements.
  • Secure or remove valuable, fragile, or irreplaceable items from the cleaning area before our team arrives. While we exercise due care, we are not liable for items not secured by the Client.
  • Ensure that the premises have running water and electricity available for our team to use during the service.
  • Inform us in advance of any pets on the premises so our team can take appropriate precautions.
  • Disclose any known health hazards, including the presence of mould, asbestos, biohazards, or pest infestations, before work commences.

6. Limitation of Liability

6.1 Service Guarantee

We strive to deliver high-quality cleaning results. If you are not satisfied with any aspect of our service, please refer to our Return and Refund Policy for details on how to request a re-clean or refund.

6.2 Damage to Property

Our team exercises reasonable care when performing services. In the event of accidental damage caused directly by our staff, we will assess the damage and, where appropriate, arrange for repair or compensation. Claims for damage must be reported to us within twenty-four (24) hours of the service. We are not liable for damage resulting from pre-existing defects, normal wear and tear, or items not disclosed to us prior to cleaning.

6.3 Limitation

To the fullest extent permitted by Malaysian law, our total liability for any claim arising from or related to our services shall not exceed the total amount paid by the Client for the specific service that gave rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages.

6.4 Force Majeure

We shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government orders, civil unrest, or severe weather conditions.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, photographs, icons, and software, is the property of Muhaiyar Facility Services Sdn. Bhd. or its content suppliers and is protected by Malaysian and international intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on our website without our prior written consent.

The Muhaiyar Facility Services name, logo, and all related marks are trademarks of the Company. Unauthorised use of these trademarks is strictly prohibited.

8. Website Use

8.1 Acceptable Use

You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the website. You must not misuse the website by introducing viruses, trojans, or other malicious material, or by attempting to gain unauthorised access to our server or any connected systems.

Both the Company and the Client agree to keep confidential any proprietary or sensitive information disclosed during the course of the service engagement. This includes, but is not limited to, business operations, security arrangements, access codes, and financial details. This obligation survives the termination of any service agreement.

10. Indemnification

The Client agrees to indemnify and hold harmless Muhaiyar Facility Services Sdn. Bhd., its directors, employees, and agents from any claims, damages, losses, or expenses arising from the Client's breach of these Terms, misuse of our services, or failure to disclose relevant information about the premises or hazards.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms or our services shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached, the dispute shall be referred to the courts of Malaysia, and both parties submit to the exclusive jurisdiction of the Malaysian courts.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Changes to These Terms

We reserve the right to update or amend these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our website or services after any changes are published constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.
